  1. PREAMBLE

1.1 Purpose and purpose of the T&Cs

The purpose of these General Terms of Use (GTU) is to define the conditions under which users, whether individuals or professionals, can access the Vitefait platform and use its services. 
 The platform offers an intermediation service allowing individuals to quickly find qualified professionals and professionals to offer their skills.

The CGU govern:

  • The rights and obligations of users and the platform;
  • Operating rules to ensure a smooth and secure experience;
  • The limitations of liability of the platform as a technical intermediary.

These T&Cs constitute a contract between the user and the company ÉVOLUSS , operator of the Vitefait platform .

 

1.2 Presentation of the platform and the services offered

Vitefait is a general online platform dedicated to connecting individuals and professionals for various services, whether urgent or planned.

The platform offers:

  • Quick and intuitive access to publish or respond to service requests;
  • Free and visible publication of services on the platform and of needs by the professionals concerned;
  • Emergency management via an optimized interface;
  • Secure communication tools to facilitate exchanges between users;
  • A review and rating system to ensure the reliability of service providers.

Vitefait is an intermediation service and does not itself offer any services or guarantees on the services provided by users.

 

1.3 Acceptance and enforceability of the T&Cs

By accessing the Vitefait platform , the user acknowledges having read these General Conditions of Use (GCU) and accepts them without reservation.

Acceptance of the T&Cs is evidenced by:

  • Explicit validation when registering on the platform;
  • Continued use of the services offered by the platform.

These Terms govern access to, use of, and participation in the Platform provided by Vitefait or its affiliates (collectively, “ Vitefait ,” “we,” “us,” or “our”). Use of the Platform and Services implies unconditional acceptance of these T&Cs, which have contractual value in any relationship between Vitefait and users, unless expressly provided otherwise.

Vitefait 's failure to use certain provisions of these T&Cs at any given time does not constitute a waiver of these provisions at a later date. In the event of invalidity of part of the T&Cs, the other provisions shall remain fully applicable.

Additionally, by using the Platform, you understand and agree that Vitefait may use your information to perform background checks, commercial credit checks with our suppliers, or otherwise verify your identity in connection with the use of the Services.

Changes to the T&Cs

Vitefait reserves the right to modify these T&Cs at any time and without notice. These modifications will be notified to users by the following means:

  • Publication of new conditions on the platform;
  • Sending a specific communication ( e-mail , notification, etc.);
  • Notification when logging into your user account.

The changes will come into effect 15 days after the first notification, whether via publication, message or connection alert. Use of the platform after this 15-day period constitutes full and complete acceptance of the changes made. If a user refuses the new T&Cs, he or she may terminate his or her account in accordance with the terms provided.

Acceptance clause

Please read these T&Cs carefully. By using the Vitefait platform , you agree to be bound by these terms. If you do not agree to these terms, you are not authorized to access or use the platform.

 

ADDITIONAL TERMS AND POLICIES

 

Users are encouraged to review Vitefait 's Privacy Policy and other policies available on the Site. In the event of a conflict between these Terms and other specific policies, the latter shall prevail.

 

2. Definitions

2.1 Definition of terms used

 

- Collective content: All user content and Vitefait content .

- Content: Text, graphics, images, music, software, audio, video, information or any other material on the Platform.

- User or Customer: Person using the Platform to seek professional services or to offer services.

- Individuals: Person using the Platform to search for professional services

- Fees: Amount invoiced by Vitefait to a user in relation to the Platform.

- Platform: Websites, mobile applications, software, video consultations, subscription services, etc., provided by Vitefait .

- Privacy Policy : Policy available at https://www.vitefait.com/politiques/.

- Services or missions: Services provided by professionals, sought or used by users on the Platform.

- Professionals: Users offering, providing or facilitating the provision of services.

Vitefait Content : Content made available by Vitefait on the Platform.

- User Content : Content submitted by users on the Platform.

 

2.2 Distinction between Individual, Professional and Platform

For the purposes of these General Conditions of Use (GCU), the following terms are defined as follows:

Particular

An individual means any natural person acting in their own name, for non-professional needs, in the context of searching for services or benefits offered via the Vitefait platform 
 Example: an individual looking for an electrician, a gardener, or a private lesson.

Professional

A professional means any natural or legal person carrying out an economic activity, registered in the trade register, the trade register or any other equivalent body, and offering their services via the platform. 
 This includes:

  • Companies,
  • Freelancers,
  • Self-employed people,
  • The self-employed, 
    the professionals registered on Vitefait act on their own account and are responsible for the services they offer to individuals or other professionals.

Platform ( Quickly )

The platform refers to the digital interface operated by the company ÉVOLUSS under the trade name Vitefait , which acts as a technical intermediary.

Role of the platform :

  • Facilitate the connection between individuals and professionals for the provision of services.
  • Offer technical tools (publication of services or needs, messaging, reviews, etc. ) to streamline interactions between users.

Platform Limitations :

  • The platform does not intervene in the performance of the services, which are carried out under the sole responsibility of the users concerned.
  • Vitefait does not guarantee the quality of the services provided by professionals, nor the payment for the services.

 

3. Access and Registration to the Platform

3.1 General conditions of access to the platform

The Vitefait platform is accessible online to anyone meeting the following conditions:

  • Be 18 years of age or older;
  • Have the legal capacity to enter into a contract (or be duly represented by a guardian or legal representative);
  • Have internet access and a compatible terminal (computer, smartphone, tablet).

Access to certain features may require the creation of a user account. The platform reserves the right to restrict or suspend access to users who do not comply with these T&Cs.

Users may access the Platform without creating an account. However, to participate in certain features, the creation of a password-protected account is required. It is possible to create an account using third-party accounts such as Facebook or Google. The user agrees to provide accurate, current and complete information during registration and to keep it as such. The responsibility for protecting the Vitefait password and, if applicable, the third-party site password, lies entirely with the user. Any unauthorized use must be immediately reported to Vitefait . Losses arising from unauthorized use of the account are not the responsibility of Vitefait . The user is responsible for losses resulting from his Vitefait account or other accounts related to unauthorized use due to his violation of these Terms.

3.2 Account creation and user obligations

 

To access the services offered by Vitefait , users must create an account by providing accurate and complete information. The steps for creating an account include:

  1. The provision of mandatory data (name, first name, email address , telephone number, etc.);
  2. Validation of an email address and phone number;
  3. Acceptance of these T&Cs.

Each user agrees to:

  • Update your information if it changes;
  • Maintain the confidentiality of your login credentials (username, password);
  • Report any fraudulent use of your account to the platform as soon as you become aware of it.

The User is responsible for all actions taken from his/her account. Vitefait shall not be held liable for any unauthorized use resulting from the User's negligence. Any unauthorized use must be immediately reported to Vitefait . Losses arising from unauthorized use of the account are not the responsibility of Vitefait . The User is liable for losses resulting from his/her Vitefait account or other accounts related to unauthorized use due to his/her violation of these Terms. Transfer of the account is only permitted with the written permission of Vitefait , in accordance with its policies and procedures.

 

Account Registration and Other Submissions

Users may access the Platform without creating an account. However, to participate in certain features, the creation of a password-protected account is required. It is possible to create an account using third-party accounts such as Facebook or Google. The user agrees to provide accurate, current and complete information during registration and to keep it as such. The responsibility for protecting the Vitefait password and, if applicable, the third-party site password, lies entirely with the user. Any unauthorized use must be immediately reported to Vitefait . Losses arising from unauthorized use of the account are not the responsibility of Vitefait . The user is responsible for losses resulting from his Vitefait account or other accounts related to unauthorized use due to his violation of these Terms. Transfer of the account is only permitted with the written authorization of Vitefait , in accordance with its policies and procedures.

3.3 Verification and validation of profiles

Vitefait may, at its sole discretion, carry out verifications of the information provided when creating an account, in particular:

  • Verification of the identity or qualifications of professionals;
  • Validation of contact details
  • Verification of the information communicated on the platform.

These checks are intended to strengthen trust between users, without engaging the responsibility of Vitefait as to the accuracy of the information provided. Vitefait also reserves the right to refuse registration or to suspend an account in case of doubt as to the conformity of the information or compliance with these T&Cs.

3.4 Account deletion or deactivation

Vitefait customer service or going through the account deletion process set up in the user's account space.

The platform may, for its part, deactivate or delete an account for the following reasons:

  • Failure to comply with these T&Cs;
  • Providing false information during registration;
  • Suspicious or fraudulent activity;
  • Prolonged inactivity on the platform (duration specified in internal policies).

Deleting or deactivating an account does not automatically delete data, unless otherwise required by law. Some information may be retained to comply with legal obligations or respond to disputes.

Vitefait reserves the right to limit, block, suspend, deactivate or cancel an account, in whole or in part, at its discretion, with or without cause, with or without notice. In the event of termination, consequences may include deactivation of the account, communication to other users of the reason for termination.

 

4. Use of the Platform

4.1 General operation of the connection

Access to and use of the Platform is reserved for persons aged 18 and over who are capable of entering into legally binding contracts. Professionals declare that they are qualified, experienced, licensed, certified, insured and in compliance with applicable laws. Vitefait is not responsible for the guarantee of professional services.

Vitefait platform acts as an intermediary to connect:

  • Individuals with specific needs ;
  • Professionals wishing to offer their services.

The general operation follows these steps:

  1. Search or post a request/offer : Users can browse services or post their needs/offers.
  2. Connection : Interested professionals respond to requests from individuals or vice versa via the platform's tools.
  3. Direct interaction : Users communicate via integrated messaging to agree on service terms.
  4. Performance of the service : Once the agreement is concluded, the service is performed outside the platform.
  5. Evaluation : After the service, a review system allows users to evaluate their experience.

4.2 Publication of requests and offers

Users can post requests or offers directly on the platform.

Conditions of publication :

  • Advertisements must be clear, complete, and comply with current legislation;
  • Users undertake to provide accurate information about their needs or services offered;
  • Advertisements that are illegal, misleading or contrary to good morals are strictly prohibited.

Moderation process :

  • Vitefait reserves the right to verify the published advertisements and to refuse or delete those which do not respect the established rules.
  • If reported by another user, an ad may be suspended for review.

Free : The publication of requests is free for individuals and the submission of offers (excluding publications of slot and emergency offers) is free for all professionals.

4.3 Communication methods between users

The platform provides an integrated messaging system to facilitate exchanges between users.

Rules for using messaging :

  • Exchanges must remain professional, respectful, and relevant;
  • Any form of harassment, spam, or inappropriate content is prohibited.

Confidentiality :

  • Users are responsible for the information they share via messaging;
  • Vitefait does not intervene in the content of exchanges, except in the case of reporting abusive behavior.

Security : It is recommended not to share sensitive information (e.g. bank details) via in-app messaging.

4.4 Reviews and Ratings

After completing a service, users can evaluate their experience by leaving a review.

How assessments work :

  • Individuals and professionals can provide a rating and comment.
  • Reviews help build transparency and trust on the platform.

Evaluation rules :

  • Reviews should be based on real experiences and reflect an honest opinion;
  • Comments containing offensive, defamatory, or irrelevant material will be moderated.

User Responsibility :

  • Users are responsible for the content of the reviews they post.
  • Vitefait does not intervene on the veracity of the opinions, except in the case of reporting abuse or fraud.

Reviews are public and visible to all users of the platform. They play a crucial role in the choice of service providers or service seekers.

 

5. Commitments and Responsibilities of Users

5.1 General obligations of individuals

Individuals using the Vitefait platform undertake to:

  • Publish clear, precise requests that meet their real needs;
  • Respond respectfully and transparently to professionals contacting them via the platform;
  • Do not cancel an accepted service without valid reason or without notifying the professional within a reasonable time;
  • Use the Platform only for personal and non-commercial purposes.

Individuals should ensure that they behave respectfully and professionally in their interactions with other users.

5.2 General obligations of professionals

Professionals using the Vitefait platform undertake to:

  • Provide services in compliance with the laws and regulations applicable to their activity (for example, insurance, professional qualifications, certifications, licenses, etc. );
  • Respect the deadlines, prices, and terms agreed with individuals;
  • Maintain a level of quality and seriousness in their services according to the rules of the art, compliance or any other rules governing the good quality of the mission or service;
  • Regularly update their offers and availability;
  • Ensure that their profile reflects their true identity and professional qualifications.

Professionals are solely responsible for the services they provide and the commitments made to individuals.

Professionals using the Vitefait platform acknowledge and certify that:

  • Their registration on the platform constitutes a declaration of their registration with the competent registers (Trade and Companies Register, Trades Directory, or any other legal body applicable according to their status);
  • They present themselves as legally established professionals authorized to exercise their activity.

Prohibition of undeclared work and legal obligations :

  • Professionals acknowledge that any practice of concealed or undeclared work is strictly prohibited on the Vitefait platform ;
  • They undertake to comply with all applicable laws and regulations, in particular those relating to the declaration of benefits and income;
  • If a professional knows or becomes aware that he is not in compliance with legal obligations, he is required to immediately delete his account.

Absence of recourse against Vitefait :

  • Professionals acknowledge that in the event of non-compliance with legal or regulatory obligations, Vitefait cannot under any circumstances be held responsible for the consequences of their actions or omissions;
  • No recourse or compensation may be requested from Vitefait in the event of an administrative, civil or criminal sanction linked to an offense committed by the professional.

Sanctions :

  • Vitefait reserves the right to suspend or delete any account in the event of failure to comply with obligations or doubts regarding the regularity of the activity carried out.

5.3 Rules of Conduct on the Platform

All users, whether individuals or professionals, must respect the following rules:

  • Do not make defamatory, insulting or discriminatory comments towards other users;
  • Do not post inappropriate, offensive or illegal content;
  • Do not use the Platform for fraudulent or deceptive activities;
  • Respect the privacy of other users, in particular by avoiding any unsolicited contact outside the framework of the agreed services.

Mutual respect and good faith are essential to ensure a positive experience for all users.

5.4 Accuracy of the information provided

Vitefait users undertake to provide accurate and truthful information when registering or publishing requests/offers.

This includes:

  • The accuracy of personal details (name, address, telephone number, etc.);
  • The sincerity of the qualifications and professional experience declared;
  • The accuracy of the descriptions of the services offered or the needs expressed.

In the event of false declarations, Vitefait reserves the right to suspend or delete the account concerned.

5.5 Prohibitions

Use of the Vitefait platform is strictly regulated, and the following behaviors are prohibited:

  1. Fraud and platform circumvention :
    1. Bypass matchmaking features to avoid obligations associated with using the platform.
    2. Providing false information or impersonating any third party.
  2. Posting illegal or inappropriate content :
    1. Publish advertisements that are contrary to the law (undeclared work, discriminatory content, etc.);
    2. Spread false or misleading information.
  3. Illegal or unauthorized activities :
    1. Using the Platform to promote illegal activities;
    2. Collect personal data of other users without their explicit consent.

As a user of the Platform, it is prohibited to:

  1. - Use another person's account, misrepresent your identity, or post inappropriate content.
  2. - Use automated systems to access the Platform without written approval.
  3. - Copy or misuse information from the Platform.
  4. - Take any action that may burden the Platform infrastructure.
  5. - Use the Platform in a manner that circumvents your payment obligation.
  6. - Collect or “sell” personal information without permission.
  7. - Violate any applicable laws or regulations.
  8. - Do not respond to requests and no longer receive communications.
  9. - Recruit or solicit inappropriately.
  10. - Take any illegal or inappropriate action, including submitting objectionable content.
  11. - Advertise services unrelated to or inappropriate for the Platform.

Submitting User Content that may harm the user experience is strictly prohibited. This includes (a) requests to download non- Vitefait mobile applications or links to mirrored websites requiring redundant information, (b) offering to purchase services outside of Vitefait , or (c) promoting services not offered on the Platform using a profile page or username.

 

You may also not take any action that is detrimental to the effectiveness or accuracy of reviews or rating systems. Users must not breach their contractual obligations by failing to perform purchased services, unless the user breaches a material term of the applicable agreement. Other prohibited actions include fraudulent conduct, billing a user outside of the Platform, refusing to provide services after payment, creating multiple accounts without authorization, circumventing payment through the Platform, and any activity that is inconsistent with the purpose of the Platform.

 

Vitefait does not guarantee or endorse users or service professionals. No agency, partnership or employment is created by the use of the platform. Users must provide accurate information. Professional and daily life advice is not exhaustive and does not constitute a guarantee.

Users are encouraged to report any illegal activity to the appropriate authority.

In the event of a violation of these rules, Vitefait reserves the right to suspend, block or delete the accounts of the users concerned, without prejudice to possible legal action.

 

  1. Role and Responsibilities of the Platform

 

Disclaimer

 

Your use of the Platform, Services or Collective Content is entirely at your own risk. Vitefait has no obligation, but reserves the right, to monitor or review User Content, and to conduct identity, background (including criminal) or registered sex offender checks on any User, including Service Professionals and Users. The Platform is provided “as is,” without warranties of any kind, either express or implied.

 

Vitefait , its affiliates and subsidiaries, and their respective officers, directors, employees and agents, expressly disclaim all warranties, including those of merchantability, fitness for a particular purpose, quiet enjoyment or non-infringement. No warranty arising from course of dealing or usage, or in trade, is given. Furthermore, no warranty, representation or guarantee is made regarding the quality, fitness, truth, accuracy or completeness of any information or material contained or presented on the Platform, including any Collective Content.

 

Limitation of Liability

 

You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the Platform and Collective Content, your offering or provision of Services, or requesting or receiving Services through the Platform, as well as any contact with other Vitefait users or third parties, whether in person or online, remains with you. Neither Vitefait nor any other party involved in creating, producing, or delivering the Platform will be liable, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, even if Vitefait has been informed of the possibility of such damages. This applies even if a limited remedy set forth herein is found to have failed of its essential purpose. Specific points include, but are not limited to:

 

(a) Any incidental, special, exemplary or consequential damages, including lost profits;

(b) Service interruption, computer damage or system failure;

(c) The cost of substitute products or services;

(d) Any damages for personal injury or emotional distress arising out of or in connection with these Terms;

(e) Use of or ability to use the Platform, Services or Collective Content;

(f) Any communications, interactions or meetings with other users of the Platform or other persons with whom you communicate or interact as a result of your use of the Platform;

(g) Your offer or provision of Services or your request for or receipt of Services through the Platform.

 

In no event shall the total and aggregate liability of Vitefait , our subsidiaries and affiliates, and their respective officers, directors, employees and agents, arising out of or related to the Terms, the Platform, the Services and/or the Collective Content, or the use of or ability to use the Platform or the Collective Content or in connection with any Services or interactions with other users, exceed the total amount of fees actually paid by you to Vitefait . Such amount shall be one hundred euros if no such payments have been made, if any. Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you. In jurisdictions that do allow limitations of liability, the limitation described above shall apply in full to residents of such jurisdictions.

 

Compensation and release

 

You agree to release, defend, indemnify and hold Vitefait and our affiliates and subsidiaries, and their respective officers, directors, employees and agents, harmless from any and all claims, liabilities, damages, losses and expenses arising out of or in any way connected with (a) your breach of these Terms; (b) your User Content; (c) your interaction with any User; and (d) the request, receipt, offering or provision of Services by you, including any injury, loss or damage of any kind incurred as a result of such provision of Services.

 

Notwithstanding the preceding paragraph, if you reside in a jurisdiction where the foregoing is prohibited, you solely agree to release, defend, indemnify and hold Vitefait and our affiliates and subsidiaries, and their respective officers, directors, employees and agents, harmless from and against any third party claims, liabilities, damages, losses and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way related to your breach of these Terms.

 

General

 

Force Majeure: Except for payment obligations, neither Vitefait nor you will be liable to each other for any delay or failure to perform under the Terms arising from any cause beyond your or our control and without your or our fault or negligence. Such causes may include, but are not limited to, fires, floods, earthquakes, strikes, unavailability of necessary public services, power outages, epidemics, acts of war declared or not, acts of regulatory bodies or other disasters. Payment of the subscription remains due even in the event of a general decline in economic activity, whatever the cause. In particular, Vitefait and the Professional agree that the occurrence of one of these causes and the taking of restrictive measures by public authorities, of whatever nature, cannot be qualified as force majeure events suspending or releasing the parties from their obligations. Furthermore, the Professional acknowledges that the inability to use the services provided by Vitefait for a personal reason (illness, strike, etc.) cannot release him from his obligations towards Vitefait .

 

No third party beneficiaries

You agree that, except as expressly provided in these Terms, there shall be no third party beneficiaries to these Terms.

 

Contacting you and E-SIGN consent

You agree that Vitefait may provide you with notices, including those regarding changes to the Terms, by email , regular mail, or posting on the Platform. With your consent, Vitefait , Users, Service Professionals, or others may also contact you by telephone or text message. If you have agreed to receive text messages or phone calls from Vitefait , Users, Service Professionals, or others, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of an electronic record by sending an email to support@Vitefait.com with “Revoke Electronic Consent” in the subject line. To view and retain a copy of this disclosure or any information regarding your enrollment in this program, you will need (a) a device (such as a computer or mobile phone) with a web browser and Internet access; and (b) either a printer or storage space on such a device. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or additional terms and conditions or policies published by Vitefait on the Platform, will constitute the entire agreement between you and Vitefait regarding the Platform or the Professional Services obtained through the Platform.

 

Vitefait does not warrant that the Platform or Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No liability is assumed for damage to your computer equipment or other property resulting from your access to or use of the Platform. Vitefait is not responsible for the defamatory, offensive, or illegal conduct of third parties, or for any loss or damage incurred as a result of the use of data, information, materials, substances, or collective content published, transmitted, or made available via the Platform.

 

No advice or information, whether oral or written, obtained from Vitefait or through the Platform, will create any warranty not expressly stated herein.

 

You are solely responsible for all of your communications and interactions with other users or users of the Platform, as well as with other persons resulting from your use of the Platform. Vitefait makes no attempt to verify the statements of users of the Platform or to examine or verify the Services. No representation or warranty is made as to the conduct of users of the Platform or their compatibility with any current or future users of the Platform. You agree to take reasonable precautions in all communications and interactions with other users of the Platform and with other persons resulting from your use of the Platform.

 

Vitefait explicitly disclaims any liability for any act or omission of any user or third party. Although Vitefait may provide professionals with the telephone numbers and email addresses provided by users as part of a request and Vitefait has performed verification of the telephone numbers and email addresses by SMS, Vitefait makes no representation or warranty as to their validity.

 

Additional provisions

 

Severability: Except as expressly provided herein, if any provision of the Terms is found to be invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Terms, which shall remain in full force and effect.

 

Waiver: No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Vitefait's failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

 

Limitation Period: You agree that regardless of any statute or law to the contrary, any claim arising out of or related to the Platform or the Services offered therein must commence within one (1) year after the cause of action arises. Otherwise, such cause of action is forever barred.

 

Section Titles: The section titles in these Terms are for convenience only and have no legal or contractual effect.

6.1 Role of simple technical intermediary

The Vitefait platform acts exclusively as a technical intermediary to connect individuals and professionals.

  • Main functions :
    • Allow individuals to publish their needs and professionals to offer their services.
    • Provide tools to facilitate communication and management of exchanges between users (messaging, notifications, evaluation system).
  • Absence of direct intervention :
    • Vitefait does not participate in the negotiation or conclusion of agreements between users.
    • The platform has no involvement in the performance or monitoring of the agreed services.

In this sense, Vitefait is not a party to contracts or agreements made between individuals and professionals.

6.2 Limitations of liability regarding interactions between users

As an intermediary, Vitefait declines all responsibility in interactions and relations between individuals and professionals:

  • User Responsibility :
    • Users are solely responsible for the information they communicate, the commitments they make and the services provided.
    • In the event of a dispute, the parties concerned must resolve their differences directly without involving Vitefait .
  • Disclaimer :
    • Vitefait is not responsible for delays, cancellations, failures to provide service or payment, or any other failure occurring in relations between users.
    • The platform does not guarantee the solvency of individuals or the reliability of registered professionals.

6.3 Absence of guarantee on the quality of the services provided

Vitefait does not guarantee the quality, reliability or conformity of the services provided by professionals.

  • Responsibility of service providers :
    • Each professional is solely responsible for the quality of the services provided and the satisfaction of individuals.
    • Vitefait does not provide any systematic control of the qualifications or services of registered professionals.
  • Ratings and Reviews :
    • The opinions and ratings published on the platform are provided by users and are their own.
    • These returns do not constitute an official validation or guarantee by Vitefait .

6.4 Maintenance and availability of services

Vitefait makes every effort to guarantee the availability and reliability of the platform, but certain limits apply:

  • Scheduled maintenance :
    • Temporary interruptions may occur for updates or technical maintenance work.
    • Vitefait undertakes to inform users as far as possible before any planned interruption.
  • Technical disruptions :

    • Geolocation of customer projects.
    • Chat room and submission of quotes/invoices for customers.
  • Pro – €39.99 per month:
    • Includes the benefits of the Discovery package.
    • Access to 20 customer files per month.
    • On-call option to guarantee availability during extended hours (7 p.m. to 6 a.m.).
  • Freedom – €59.99 per month:
    • Includes all the benefits of the Pro plan.
    • Unlimited customer records.
    • Access to advanced services such as Emergency and Slots .
    • Priority customer support (VIP).

2. Specific Services:
 Certain services are accessible with additional fees or included in advanced subscriptions:

  • On-call : Allows professionals to report that they are available outside normal hours (7 p.m. to 6 a.m.). Included in the Freedom package.
  • Emergency : Posting of urgent announcements immediately accessible to users. Works via a unit payment or is included in the Freedom package.
  • Slots : Reporting of specific availability by the professional, also accessible individually or included in the Freedom package.

No commissions are charged on transactions for services provided by the platform.

7.2 Payment Terms

Professionals agree to pay the applicable fees according to the terms defined by the platform. Here are the main provisions:

1. Payment methods:

  • Payment by bank card (debit or credit).
  • Other electronic means (PayPal, digital wallets, etc.), if available.

2. Automatic Renewal:

  • Subscriptions are automatically renewed at the end of each period.
  • Users can cancel the renewal by giving notice (15 days for monthly/quarterly subscriptions and 30 days for annual subscriptions).

3. Penalties:

  • Fees may apply in the event of:
    • Late payment.
    • Circumvention of general conditions.
    • Violation of platform rules.

In the event of non-payment, Vitefait may suspend or terminate the user's access to the services.

  • Communication channels ( email , chat, telephone calls) are subject to this monitoring within the limits of current legislation.

2. Recording of Transactions:

  • All transactions made through the platform are recorded and accessible to users from their personal space.
  • In the event of a dispute, these recordings may be used as evidence to arbitrate disputes.

3. Data Security:

  • Users' financial data is protected by encryption protocols.
  • No banking data is stored directly by Vitefait ; they are processed by specialized level providers ( stripe , paypal , etc. ).

Unsubscribe and Termination

1. Conditions of Termination:

  • Termination must be requested via the professional's personal space.
  • In the event of non-compliance with the notice periods, the subscription is automatically renewed.

2. Termination fees:

  • A penalty of €30 may be applied, except for annual subscriptions or after continuous use.

3. Specifics of Free Trials:

  • Free trials are not subject to any cancellation fees.

8. Intellectual property

8.2 User Compliance with Third Party Intellectual Property

Restrictions : The Platform and Collective Content are provided “as is”. By making User Content available, User grants Vitefait a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license to:

User guarantees:

11. Sanctions and termination

  • Disputes between the user and Vitefait are subject to individual arbitration, excluding class actions. The parties agree to resolve disputes through good faith negotiations, with arbitration as a last resort. However, intellectual property disputes and claims before the courts are exceptions to this arbitration clause.

  • Users may report any inappropriate or abusive behavior through the reporting tools integrated into the Platform or by contacting support.
  • Vitefait will analyze each report diligently and reserves the right to take measures, such as:
    • Temporary suspension or permanent deletion of the offender's account.
    • Reporting to the relevant authorities in the event of a serious or illegal violation.

13.3 Applicable Law and Competent Jurisdiction

  • The General Conditions of Use (GCU) and the relationship between the user and Vitefait are governed by French law. Any dispute not subject to arbitration must be resolved before a court located as close as possible to the company's headquarters, unless otherwise agreed.
  • In the event of a dispute not resolved amicably, the competent courts will be those of the jurisdiction where Vitefait 's head office is located , unless otherwise provided by law.

14.2 Non-waiver

  • The fact that Vitefait does not exercise a right or does not require the execution of a provision of these T&Cs does not constitute a waiver of this right or this provision.
